to be NWFP minister

PESHAWAR: On expiry of constitutional period allowed to hold the office of a minister for more than six months without being a member of the assembly, the NWFP government on Wednesday issued a notification about dismissal of Giyan Singh from the Provincial Cabinet.

The notification released here from the S&GAD department reads as, "In pursuance of the judgement of the Chief Election Commissioner (CEC) of Pakistan dated 1-10-1998 in reference number 18/98 and in accordance with the provision of Article 130 (7) of the constitution of 1973, Engineer Gayan ceases to be a provincial minister with effect from 1.4.1999."

It is to be mentioned here that Giyan Singh was declared disqualified by the CEC on October 1, 1998 on a reference sent to him by the central president of Awami National Party (ANP) Ajmal Khattak, through speaker, NWFP Assembly.

The reference was sent by ANP under Article 63-A of the Constitution (Anti-Defection Law) when Giyan joined the provincial Cabinet as the provincial minister for minority affairs.

After deseating Giyan Singh from Provincial Assembly membership, the CEC had fixed November 21, 1998 for by-elections on the reserved seat of minorities.

The CEC decision was challenged by Giyan Singh at the Peshawar High Court (PHC) which stayed by-elections on the vacant seat till the adjudication of the main petition. Hearing on the main case of disqualification is in progress and next date of it is April 6 next.ÑAPP�
