MoC summons FPCCI CCIs to finalise draft anti-dumping law

KARACHI: The Ministry of Commerce has summoned a meeting to discuss finalisation of draft anti-dumping legislation so that the same could be implemented without loss of time.
The meeting will be held on April 19 and presided over by Commerce Secretary. A copy of the draft legislation has been circulated among trade bodies soliciting their views/comments.
Representatives of the FPCCI, Chambers of Commerce and Industry, Karachi, Lahore, Quetta and Peshawar. Secretary, Ministry of Industries and Production, Chairman of National Tariff Commission and Chairman of the Central Board of Revenue have also been invited to attend the meeting.
The draft legislation consists of two parts. Part one deals with anti-dumping measures : definitions and principles, determination of dumping, injury and causal link, initiation and conduct of investigations, conclusion of investigation, and duration and review of anti-dumping duties and prices undertakings.
Part two deals with countervailing measures : definitions and principles, determination of countervailable subsidy, adverse effects and causal link, initiation and conduct of investigations, conclusion of the investigation, duration and review of countervailing duties and price undertakings, service countervailing measures, multilateral disciplines and regulations of Pakistan, administration and judicial review process, circumvention, and final provisions.
The National Tariff Commission is proposed to be incharge of administering the anti-dumping legislation of Pakistan in general and the Central Board of Revenue will be the competent authority incharge of collecting customs duties at the direction of the National Tariff Commission.
The National Tariff Commission shall normally make a final determination of dumping, injury and causal link with 180 days of the preliminary determination. The final determination shall be based on all information obtained by the National Tariff Commission during the course of investigation that has been disclosed to interested parties, subject to the confidentiality requirements of section 33.
The National Tariff Commission shall issue a public notice of the final determination, whether affirmative or negative. The notice of final determination shall include all relevant information on the matters of fact and law and reasons that have led to the determination, due regard being given to the requirement for the protection of confidential information, and in particular : the names of the known exporters and producers of the investigated product, description of the investigated product that is sufficient for customs purposes, including the current Pakistani tariff classification.
