ORDINANCE NO.LXVI OF 2000
AN
ORDINANCE
to amend the Control of Narcotic Substances Act, 1997
WHEREAS it is expedient to amend the Control of Narcotic substances Act, 1997 (XXV of
1997), for the purposes hereinafter appearing;
AND WHEREAS the National Assembly and the Senate stand
suspended in pursuance of the Proclamation of Emergency of the fourteenth day of October,
1999 and the Provisional Constitution Order No.1 of 1999;
AND WHEREAS the President is satisfied that circumstances exist which render it necessary
to take immediate action;
NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of
October, 1999, and the Provisional Constitution Order No. 1 of 1999, read with the
Provisional Constitution (Amendment) Order No.9 of 1999, and in exercise of all powers
enabling him in that behalf, the President of the Islamic Republic of Pakistan is pleased
to make and promulgate the following Ordinance;
1. Short title and commencement.--(1) This Ordinance may be called the
Control of Narcotic Substances (Amendment) Ordinance, 2000.
(2) It shall come into force at once.
2. Amendment of section 33, Act XXV of 1997.-- In the Control of Narcotic
Substances Act, 1997 (XXV of 1997), hereinafter referred to as the said Act, in section
33.--
(a) in sub-section (2), for the second proviso, the following shall be substituted,
namely:-
"Provided further that if any such article other then a narcotic drug, psychotropic
substance or controlled substance is liable to speedy and natural decay or in case of
vehicle, the Director General, Anti-Narcotic Force, or any other officer authorized by
notification in the official Gazette by the Federal Government, is of opinion that the
sale of such article or vehicle is for the benefit of its owner, he may, with the approval
of the Special Court, after due notice to the owner and by public auction, direct that the
article or, as the case may be, the vehicle be sold in accordance with the rules make
under this Act and the sale proceeds shall be deposited in the National Fund for Drug
Abuse till the final judgement of the court,";and
(b) for sub-section (3) of the following shall be substituted, namely:-
"(3) If on adjudication or, as the case may be, in case of appeal the vehicle or, as
the case may be, an article so sold is found not to have been liable to such confiscation,
the entire sale process shall be handed over to owner,".
3. Amendment of section 74, Act XXV of 1997.- In the said Act, in section
74, in the provisio, after the word "case", at the end, the words, brackets and
figures "except as provided in the second proviso to sub-section (2) of section
33" shall be added.
