GOVERNMENT OF PAKISTAN MINISTRY OF COMMERCE
ORDER
Islamabad, the 21st August, 2002

S.R.O. 539 (1)/2002.--- In exercise of the powers conferred by sub-section (1) of section 3 of the Imports and Exports (Control) Act, 1950 (XXXIX of 1950), the Federal Government is pleased that the following further amendments shall be made in the Import and Procedures Order 2000, namely:-

In the aforesaid Order,-
(a) in paragraph 2,--
(i) clauses (b), (g) and (i) shall be omitted; and
(ii) in clause (i) the commas, words, brackets and figure, "and is registered as such under the Registration (Importers and Exporters) Order, 1993" shall be omitted; and

(b) paragraph 4, shall be omitted;
(c) for paragraph 5, the following shall be substituted,

"5. Basis of imports,--(1) Imports may be made against all modes of payment subject to procedures prescribed by the State Bank of Pakistan from time to time:

Provided that the private sector concerns may enter into Commodity Exchange 'Arrangement subject to the procedure notified by the State Bank of Pakistan.

(2) For the purposes of proper classification of products being imported the First Schedule to the Customs Act, 1969 (IV of 1969) shall be referred to and shall have effect accordingly.

(3) Imports under loans credits or bilateral assistance that require the contract to be approved by Economic Affairs Division, or some other agency of Government of Pakistan. Letter of Credit shall have to be established within sixty days of registration of contract with a bank designated by the State Bank of Pakistan.

(4) Public sector agencies shall open Letter of Credit through a bank designated by the State Bank of Pakistan";

(d ) in paragraph 6,-
(i) in sub-paragraph (1) in the proviso for the words, comma and figure "the No Duty No Drawback Rules, 1998" the words, comma and figures "Duty and Tax Remission for Export as provided in sub-chapter 7 of chapter XII of the Customs Rules, 2001" shall be substituted;

(ii) in sub-paragraph (6), the words letters and full stop "Banks and Customs authorities shall ensure fulfillment of these conditions at the time of establishment of LC's and clearance of goods" shall be omitted; and

(iii) After sub-paragraph (17), the following new sub-paragraphs shall be added, namely:-
"(18) Import of edible oil in bulk quantity shall be on landed weight and quality basis.
(19) Banks and Customs shall also ensure that all requirements, conditions, and restrictions etc., as set out in this Order are duly complied with";

(e) paragraph 9 shall be omitted ;

(f) in paragraph 10, in the proviso, -
(i) for the figure "15,000" the figure "30,000" shall be substituted; and
(ii) after the full stop, at the end, the words, comma and full stop "Industrial users who are also exporters may import spares, etc., beyond this limit subject to a maximum of five per cent of their last year's exports'" shall be added ; and

(g) in paragraph 17, in the proviso,-
(i) for the word "Central Board of Revenue" the word "Federal Government" shall be substituted ; and
(ii) after the word "specify", the words "from time to time" shall be inserted.
