GOVERNMENT OF PAKISTAN MINISTRY OF COMMERCE
ORDER
Islamabad, the 22nd June, 2000

S.R.O. 424(I)/2000.-- In exercise of the powers conferred by sub-section (1) of section 3 of the Imports and Exports (Control) Act, 1950 (XXXIX of 1950), the Federal Government is pleased to direct that the following further amendment shall be made with immediate effect in the Textile Quota Management Policy Order, 2000, namely:--

In the aforesaid Order;

(1) in paragraph 5 in sub-paragraph (5), after the first proviso, the following new proviso shall be inserted, namely:--

"Provided further that exporters who got reservation on first come, first served quota quantities, the category pass-books of such exporters only for that category shall be allowed transfer out only on surrender of penalty equal to twenty five per cent of quota reserved";

(2) for paragraph 13, the following shall be substituted, namely:--

"13. Use of flexibilities.--(1) Exporters shall be entitled to the flexibilities on their authenticated entitlements including quotas obtained through transfer-in and auction.

(2) The percentage of flexibilities as admissible under the bilateral textile agreements shall be announced by the Quota Supervisory Council on the 1st day of January each year. Such percentage of flexibilities shall be calculated and allocated to the exporters on the basis of current year’s entitlement plus the net quota (i.e. transfer-in less transfer-out) acquired by them during the currency of the quota year.

(3) The exporters who avail the flexibilities according to their entitlements, shall not be allowed any transfer out from their respective category Pass Books"; and

(3) for paragraph 21 the following shall be substituted, namely:--

"21. Power to issue clarification. As and when necessary, the Quota Supervisory Council may, in consultation with the Vice-Chairman, Export Promotion Bureau, and with the approval of the Ministry of Commerce, issue clarification of any provision of this Order."
